General

• Payment of a deposit or full booking fee confirms you accept all the terms and conditions on this page.

• You must be aged 18 years or over to attend a workshop/private tuition unless you are accompanied by a parent or legal guardian

​Booking and Payment

• ​​Bookings are on a first in, first served basis.

• A deposit of 10% is required at the time of booking.  This is an administrative fee and non-refundable except as outlined in the Cancellation and Refund Policy below.

• The balance payment is required at least 30 days prior to the workshop/private tuition start date.

• Only when full payment is received will your workshop/private tuition registration be guaranteed.

• If full payment is not receive at least 30 days prior to the workshop/private tuition start date I reserve the right to cancel your booking.

• I'm open to discussing part instalments of the balance payment; this is purely at my discretion, but please contact me if this is the only option that works for you. Again, full payment must be made 30 days before the workshop starts.

• All payments must be made via Online Bank Transfer or Paypal.

• Paypal transaction will incur a 4.4% paypal charge.

 

​Cancellation and Refund Policy

​

Cancellation by you:​

• All cancellations must be made in writing to Rachel Roberts Photography

• If you cancel and I manage to refill your spot, I’ll provide a full refund, including the deposit.  However, please note I can’t guarantee I’ll fill your spot.

• If I don’t manage to refill your spot, the following refunds will apply depending on the time of cancellation:

  • At least 90 days prior to the workshop/private tuition start date: full refund of any payments made, minus the non-refundable deposit.

  • Between 90 and 60 days prior to the workshop/private tuition start date: 50% refund of any payments made, minus the non-refundable deposit and fixed or committed non-refundable costs which I have incurred in arranging the postponed workshop/private tuition for you.

  • Less than 30 days prior to the workshop/private tuition start date: No refund.

Cancellation by me:

Although an unlikely event, I reserve the right to cancel or postpone a workshop/private tuition at any time. Some reasons I might do this include (but are not limited to): weather, illness, family emergency, too few participants, natural disasters, Government-issued travel restrictions, and other reasons beyond my control.

If I cancel the workshop/private tuition, all payments made will be refunded, including the deposit

If I postpone the workshop/private tuition to a later date, one of the following options will apply:

• I will credit any payments you have made to a future workshop/private tuition, or

• I will refund you any payments made including the deposit but less your share of any fixed or committed non-refundable costs which I have incurred in arranging the postponed workshop/private tuition for you.

In the extremely unlikely event a workshop/private tuition needs to be terminated during the course of the workshop/private tuition, I will work through a fair and reasonable partial refund solution with you. The amount of the refund will depend on how far the workshop/private tuition has advanced and other related circumstances.  Rachel Roberts Photography is not responsible or liable for any costs you incur following the termination.

Third party providers and fixed or committed non-refundable costs 

• For any third party provider activities booked, for example a helicopter flight,  the helicopter company's Safety Management System applies and must be adhered to.

• If a third party activity has to be cancelled by them due to, but not limited to weather, and  I have included the cost into your workshop fee, the amount of the activity will be refunded in full.

• Should you cancel the workshop, any refunds for third party/fixed or committed non-refundable costs are non applicable unless I fill your spot.

Insurance​

I do not hold insurances for your personal circumstances, including but not limited to your workshop/private tuition fee, personal travel (for example, flights to and from the tour/workshop), medical, and personal items.

I strongly recommend you obtain:

• travel insurance to cover you in the event of a tour/workshop cancellation by either you or me, or for any emergencies and any other reasons beyond my control

• medical insurance to cover you for your personal health needs

• appropriate personal and third-party insurance for the cover of damage or loss of equipment and property.

I do not accept responsibility, liability or any expenses for insurance related costs incurred by participants in preparation for or participation in a workshop/private tour.

 

Itinerary Changes​

• Where weather conditions or forces of nature restrict or prohibit workshop/private tuition activities I reserve the right to alter the itinerary to travel further afield and/or substitute alternative activities. This may include day landscape photography and steel wool night photography.

• I also reserve the right to change the itinerary should photography opportunities be better suited elsewhere for non-weather related reasons.

• You acknowledge that landscape photography is subject to many variables including but not limited to environmental conditions that cannot be guaranteed.

• In the rare instance that we completely miss out on clear skies, you will be given files of my own in which we will edit intensively. We can also edit images of your own that you have previously captured.

 

Fitness, Health & Behaviour

You must assess your own level of fitness for the tour/workshop you join. 

At the time of booking, and immediately prior to the tour/workshop, you need to make me aware of any medical conditions, health or fitness related issues that could affect the outcome of the workshop/private tuition for yourself or others.

If at any time I assess your medical conditions, fitness or health will affect the outcome of the workshop/private tuition for yourself or others, I reserve the right to release you from the workshop/private tuition. Refunds will be considered in accordance with my Cancellation and Refund Policy above.

Inappropriate behaviour or actions that disrupt the workshop/private tuition or the rights of other participants will not be tolerated. In this case the offending participant will be released from the workshop/private tuition with no refunds given.

 

​Loan Gear

If you choose to use any of the photography gear supplied by Rachel Roberts Photography, although it is insured you are responsible and liable for paying up to and including the excess value for any damage, breakage, loss, or theft of that gear. 

 

​Safety

I have a comprehensive Safety Management System in place audited by ROSA, through a company I co own called Southern Photography Adventures. Please as ask to see our full SMS.

Before (and during the workshop/private tuition if plans change) you'll be required to sight and sign numerous Risk Register documents outlining the (potential) risks and hazards to every area we intend to visit.  This paper work, as cumbersome as it seems is required by NZ's strict health and safety laws and is mandatory for me to safely and lawfully run my workshops/private tuitions.

Waiver of Liability

I’ll work incredibly hard to provide you with a safe and enjoyable experience during the workshop/private tuition. However, because of the nature of photography and the environment we may be exploring, there will always be the potential for certain risks, unforeseen circumstances and dangers to arise, and I accept no responsibility, liability or expenses caused by these.  These can include but are not limited to: injury, death, illness, accident, quarantine, strike, damage or loss of equipment and property, and expenses of any nature.​

Similarly I accept no responsibility, liability or expenses incurred due to unforeseen delays.  These can include but are not limited to: weather, natural disasters, theft, criminal activity, political disturbance, failure of transportation to arrive on time, and airline scheduling.

At the booking stage and the beginning of the workshop/private tuition you’ll need to sign several documents including:

• Risk Disclosure document

• Risk Registers for all areas we intend to visit to make you aware of any potential hazards

• Client Gear checklist

 

•    You will need to:

• Have any medical conditions disclosed that could impact your safety or the safety of other participants

• Have the required level of fitness for the workshop/private tuition

• Have the appropriate insurances for your personal items, medical needs, and travel arrangements plus any other cover required (of if you have no insurances accept those risks)

• Carry the appropriate gear, clothing and personal items as required for the tour/workshop

• Voluntarily assume all risks and will hold Rachel Roberts harmless from any and all liability, actions, causes of action, claims, debts, and demands which arise in connection with the workshop/private tuition.

Promotion

During a tour/workshop I may take photographic or video records in which you may appear.  Such material may be used for promotional purposes including but not limited to our website and social media channels.

If you do not wish to appear in any promotional material please advise at the time of booking.

Privacy​

I collect the personal information you have supplied during the booking process, including your name and contact details.  I collect this personal information in order to complete the booking process and to allow me to maintain my relationship with you prior to, during, and after the workshop/private tuition.

You have the right to ask for a copy of any personal information I hold about you, and to ask for it to be corrected if you think it is wrong. If you’d like to ask for a copy of your information, or to have it corrected, please contact me.

Your personal information remains private with me.
